Otter Products Seeks $14 Million Judgment Against Logistics Firm Over Counterfeit Phone Case Scandal

New York, NY – May 23, 2025 — Otter Products, LLC, the manufacturer behind the globally recognized OtterBox line of mobile device cases, has filed a motion in the U.S. District Court for the Southern District of New York seeking a $14 million default judgment and a permanent injunction against logistics company 4PX Express USA Inc. for willful trademark counterfeiting.

The motion, filed by Otter’s counsel at Lee Law PLLC, accuses 4PX of repeated and deliberate distribution of counterfeit OtterBox products despite a prior lawsuit and multiple warnings, including notices from U.S. Customs and Border Protection.

According to the court documents, Otter Products first sued 4PX in 2021 for its role in shipping counterfeit OtterBox cases on behalf of overseas eBay sellers. Despite that case, Otter alleges that 4PX resumed its illegal activities—ultimately leading to the current lawsuit.

“This is a clear case of willful infringement,” said Michael Lee, counsel for Otter Products. “The defendant not only continued distributing counterfeit products after a lawsuit, but also attempted to deceive the court and obstruct discovery.”

Otter’s filing outlines a pattern of bad faith behavior by 4PX, including refusal to produce evidence, ignoring court orders, and dismissing counsel in an apparent effort to stall proceedings. The company eventually defaulted in the case, prompting Otter to pursue the maximum statutory damages permitted under the Lanham Act: $2 million for each of its seven infringed trademarks.

In addition to monetary relief, Otter Products is seeking a permanent injunction to bar 4PX from further infringement.

The motion emphasizes the importance of deterring large-scale counterfeiting operations and protecting consumers from knock-off products that lack the durability and quality of genuine OtterBox merchandise.

The court has not yet ruled on the motion.
