OtterBox has filed a lawsuit against an eBay seller that complained about OtterBox trying to enforce its rights.
OtterBox has filed a new lawsuit against defendant, Dominick Cidoni, the Complaint for the lawsuit can be found here. According to the Complaint, Cidoni was caught repeatedly selling counterfeit cell phone cases despite receiving a cease and desist letter. Further, when implored by OtterBox’s counsel to stop his illegal behavior, Cidoni complained that counsel needs to stop calling and emailing because it bothered him. Since he failed to stop his illegal sales despite notice, OtterBox filed suit.
OtterBox seeks damages and its costs. Treating a company’s attempts to protect its customers from fakes shouldn’t be treated like a mere annoyance.
