If It’s Too Good to Be True, It May Be a Counterfeit

OtterBox, the cellphone case company, has commenced a new lawsuit against an eBay user. According to the Complaint, the defendant claimed to receive 150 free cell phone cases from a stranger. Not surprisingly, these cases were fake and now the “lucky” receiver of the free cases has been sued.

In a new case filed in the Southern District of New York, that can be found here, OtterBox sued an eBay seller that refused to resolve claims of counterfeiting and infringement. As set forth in the Complaint, this eBay seller claims that an absolute stranger gave his girlfriend 150 cell phone cases for free. Sometimes you get what you pay for. These cases turned out to be unauthorized cases bearing counterfeit trademarks.

If this story is to be believed, it demonstrates that products should only be purchased from authorized sellers or legitimate retailers. The cheap becomes expensive fast as this defendant now has to defend a Federal lawsuit in New York.
