Continuing its zero tolerance campaign against those caught selling counterfeits on eBay, OtterBox and LifeProof have filed lawsuits against two eBay sellers who refused to settle their disputes with the companies after receiving cease-and-desist letters.
First up, the lawsuit (which can be found here) filed against Las Vegas native, Norjelyn Maldonado who was caught selling counterfeit OtterBox product. The Complaint alleges that under the eBay user name “sassy.little.lady” the defendant was selling illegal goods. The Complaint further alleges that despite a cease-and-desist letter being sent to her, the defendant failed to respond and continued selling her illicit merchandise.
The second lawsuit (which can be found here) alleges that the Florida-based defendant, was caught on numerous occasions selling illegal OtterBox and LifeProof merchandise. The Complaint further alleges that despite several warnings the defendant failed to stop his illegal sales.
Both of these lawsuits were filed in the Southern District of New York Federal Court as these defendants sold their illegal goods into New York. These lawsuits provide a warning as to the consequences of selling counterfeit goods.
