Seeing brothers go into business together is nice, when these brothers allegedly sell counterfeit cell phone cases, its not so nice. OtterBox, the makers of the popular cellphone case, has filed suit against the owners of three discount stores that got caught selling illegal cases; and continued to do so despite being warned not to do so.
In a new lawsuit filed by Lee Law on behalf of OtterBox, the company accused a Michigan-based chain of discount stores of selling knock-off OtterBox cases on eBay. According to the Complaint, under the username korting_outlet, the defendants, Grand Rapids Liquidators LLC and brothers Blake and Ross Kunzi, were caught selling counterfeit cases. Despite receiving a cease-and-desist letter, the defendants continued to distribute their illegal products. Besides the eBay account, defendants operate three retail locations and a website.
OtterBox seeks damages of up to $2 million per trademark infringed plus its attorneys’ fees. Thanksgiving dinner might get a little intense this year for the Kunzi family.
