Otter Products, LLC, the globally recognized manufacturer of durable protective cases for electronic devices, has filed a lawsuit in the United States District Court for the Southern District of New York against Gunnar Singleton and unnamed accomplices for alleged trademark counterfeiting, infringement, and deceptive trade practices.
The lawsuit alleges that Singleton, operating under the eBay username “gunnasingleto0,” knowingly and willfully sold counterfeit OtterBox® merchandise bearing unauthorized reproductions of Otter Products’ federally registered trademarks. These sales were conducted despite multiple complaints from consumers and a cease-and-desist letter sent by Otter Products in early 2025.
According to the Complaint, an agent of Otter Products purchased one of the alleged counterfeit items from Singleton’s eBay store and confirmed that it was a fake. The lawsuit details that Singleton attempted to evade accountability by refusing to disclose attorney contact information and failing to cooperate with Otter Products’ legal inquiries.
Otter Products seeks injunctive relief, statutory and /or actual damages—including up to $2 million per counterfeited mark—as well as attorneys’ fees and destruction of the counterfeit goods. The company also asserts that Singleton’s actions have caused irreparable harm to its brand and consumers.
The case number is 1:25-cv-4501 and is being handled by Lee Law PLLC in New York City.
